Types of evidence to build a strong personal injury claim

Evidence is key to creating a strong personal injury claim. Evidence not only helps to prove fault, but it also shows the extent of financial loss and helps to solidify damages.

If you or a loved one is seeking to build a personal injury claim, you want to have the right evidence. There are a few types of evidence that will benefit any case.

Documentation

Documentation is the most common type of evidence that parties present in a personal injury case. Some common forms of documentation include:

These are just a few of the possible types of documentation. Thankfully, there are some rules and regulations in place that help to enforce this type of evidence. For example, Wisconsin law 346.70 states that after an auto accident, law enforcement or the parties involved must report the incident. 

Witnesses

Witness testimony helps to make a claim in some cases. An eyewitness to an accident may help to validate the claims of either party. In other cases, such as medical malpractice, an expert witness testimony may either validate the actions of the physician or denote negligence. In the case of eyewitnesses, it is best to obtain their contact information and statements as soon as possible after the incident.

Photos

There is a common saying that a picture is worth one thousand words. This holds true for personal injury cases. Photos, as well as videos, allow the courts to see the incident or its ramifications with their own eyes. Depending on the case and what the photo captures, it makes claims practically undeniable or at least solidifies them. If video is available, that is even better.
